This Privacy Policy is meant to help you understand the information we collect, why we collect it, and how you can manage it. By using our Site, or by purchasing our Products and/or Services, you are acknowledging that you have read, understood, and accept this Privacy Policy and our Terms and Conditions.
In this Privacy Policy, any use of the words “you,” “yours,” or similar expressions refers to users of this Site and our Products and/or Services, as well as any other individuals whose information we collect and process. References to “we,” “us,” “our” or similar expressions refer to Slumberland.
This Privacy Policy does not extend to anyone whose personal information is not under our control or management, including data that is collected by other websites that you may visit before or after this Site, and which are not governed by this Privacy Policy. While we require our franchisees to adhere to the principles and practices outlined in this Privacy Policy when handling personal information, each franchisee operates as an independent business. As such, we do not control and are not responsible for the privacy practices of our franchisees. g. Information such as search words and phrases you provide when you use the search functionality, search box, or search engine on our Site. 1.2. Information from Children
Slumberland does not knowingly solicit or collect any personal information from anyone under 16 years of age, and children under 18 are not permitted to register for or use our Site or Services, including by subscribing to receive information from Slumberland. Parents can contact our customer service department to access, change, or delete the personal information that has been submitted by a child. If we become aware that a child under the age of 16 has provided us with personal information, we will delete it.

3. How Information May be Disclosed
Slumberland does not sell or rent any of your personal information for monetary consideration. However certain states define “sale” or “share” more broadly than as commonly interpreted. We engage in online activities that may constitute a sale or a share (for behavioral advertising) of personal information. This may include showing you targeted or customized advertisements on other websites. You may opt out of such targeted advertising or selling or sharing of your personal information as set forth in the “Managing Cookies” section above. 4. Retention Of Your Information
Slumberland will retain your information only for as long as is necessary to perform the relevant processing activity for that information, or as long as is set out in any relevant contract you hold with us. The relevant retention period is determined on a case-by-case basis because it depends on things like the nature of the data, why it is collected, why it is processed, and any relevant legal or operational retention needs. For example, we may retain your data for as long as you are a customer of ours so that we may process and complete any orders you may make with us. We may also be required to hold some types of your information to fulfill legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce policies. Slumberland’s Site and Services are tailored for, and targeted to, users in the United States of America (“U.S.”). Because Slumberland is a U.S.-based company, your information may be collected and processed in the U.S. Additionally, as part of the Products and/or Services offered to you through our Site, the information which we collect about you may be transferred to, and stored in, one or more countries other than where you currently reside. For example, this may occur if any of our servers or third-party service providers are located in a country other than yours. These countries may have different data protection laws that apply to personal information. However, if we transfer your information in this way, we will put in place appropriate protection to make sure your information remains adequately protected and is treated in line with this Privacy Policy.
Your consent to this Privacy Policy followed by your submission of such information represents your agreement to any such transfer.
6. Security of Your Information
We take the security of your personal information seriously and follow industry-standard practices to protect the data we collect and process. Slumberland has therefore put in place commercially reasonable physical, electronic, and managerial procedures designed to safeguard and secure the personal information that Slumberland collects. Access to personal information will be restricted to our authorized personnel who require the information to perform their duties properly. In addition, access will be limited to only that information that is strictly necessary for the performance of those duties.
Remember, the safety and security of your information also depends on you. Where you have chosen, or where we have given you a username and password for access to certain parts of the Site or Services, you are responsible for keeping your login credentials confidential. No method of transmission over the internet, or method of electronic storage is completely secure, so Slumberland cannot guarantee its absolute security.
7. Email and Mobile Device Notifications
We try to keep email communications to a minimum and give you the ability to opt-in/opt-out of any marketing communications we may send. For example, we may use your information to contact you with newsletters, marketing, or promotional materials and other information that may be of interest to you. You may opt-out of receiving any, or all, of marketing communications from us (other than certain required communications, such as messages confirming orders, and notifying you of any privacy policy updates, and the like) by following the unsubscribe link, instructions provided in the communication, by contacting us at feedback@slumberland.com stating your request, or, as applicable, by texting STOP in reply to our text messages.
We may use email and text marketing vendors to manage and send emails and SMS texts to you, including abandoned cart reminders. Klaviyo is one of our vendors, and its Privacy Policy can be viewed at https://www.klaviyo.com/privacy/policy. When we send a SMS message, we and our vendors may collect and process certain personal information such as your phone number, country code, mobile carrier and carrier region, IP address, and user submitted address (if provided). We use such data to support message routing and delivery times, and determine a recipient’s local time zone and quiet hours. We may disclose your SMS opt-in or consent status with third parties that help us provide our messaging services and send the text messages. We will not share or sell your phone number or your opt-in to the SMS with unaffiliated third parties for their direct marketing purposes or for purposes unrelated Site.

8. Personal Information Rights for Residents of Certain U.S. States
8.1. Right To Know About The Personal Information We Collect And Share
U.S. State laws may give you the right to request that we disclose the personal information we have collected about you over the past 12 months, which we only provide after we receive and validate your request. Once we receive and confirm your verifiable request, we will disclose to you:

8.3. Right of Correction

8.4. Right of Deletion
You may have the right to request erasure of your personal information, subject to certain exceptions, such as when we have a legal obligation to retain the data in question. After we receive and validate your request, we will delete your personal information, as well as direct our service providers to delete your personal information unless an exception applies.
8.5. Slumberland eClub and Notice of Financial Incentive
We provide special offers and benefits to customers participating in our Slumberland eClub loyalty program. Customers may join online or in store; Slumberland credit card applicants join The Slumberland eClub loyalty program as part of the credit card application process. Participation in The Slumberland eClub is voluntary and Slumberland eClub members may withdraw from the Slumberland eClub loyalty program at any time by contacting our customer service team via email at feedback@slumberland.com or by calling 1.888.95.SLUMBER. The personal information we request from customers when they sign up for The Slumberland eClub includes their name, email, and phone number, so we can send reward and program-related information (including relevant marketing) and ensure that purchases are associated with the correct Slumberland eClub account. A Slumberland eClub member may also share personal information with us through their Slumberland account, including username and password, billing, mailing, and shipping addresses, phone number, and payment method (e.g., credit card) information, and brand preferences, or through purchases they make online or in store, for purposes of creating a better online and/or in-store shopping experience. When a Slumberland eClub member accesses our website or makes a purchase, we collect the same personal information as we do from other Slumberland customers as detailed above in this Privacy Policy. We use and disclose any information we collect as part of our loyalty program as described in this Privacy Policy. If you request that we delete any of your personal information that is essential to providing you with the Slumberland eClub loyalty program, we will not be able to provide you with the benefits of that program (e.g., if you ask us to delete your phone number, we will no longer be able to maintain your loyalty account).
While we do not assign a monetary value to the personal information we collect from Slumberland eClub members in exchange for the benefits The Slumberland eClub program offers, we do receive value in the form of customer loyalty and increased purchase engagement. In determining the value to Slumberland, we consider the revenue generated from activities related to the collection and retention of Slumberland eClub members’ personal information less expenses related to providing The Slumberland eClub program and benefits offered. This value will vary by member depending on purchases made, where those purchases are made (in store or online), which offers a member takes advantage of, and many other factors.
8.6. How to Make Disclosure, Access, Correction, or Deletion Requests
If you reside in a state that provides for enhanced privacy rights, you can request disclosure, access to, correction, and/or deletion of your personal data as described above by submitting a verifiable consumer request to us by:
• Accessing our Preferences Center tool or sending an e-mail to feedback@slumberland.com including the following information along with your request: your full name, company name (if applicable), address, e-mail address, and a phone number. We may request that you provide additional information if necessary to confirm your identity. This is for security purposes and is required by law in some cases.
• Only you, or a person registered with the appropriate mechanism associated with your state of residency that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.
• You may have the right to make a free request up to two times in any 12-month period. We will respond to all validated requests within 45 days of receiving your request, unless we request an extension. If we reasonably require an extension to respond to your request, we will notify you of any such extension within the initial 45-day period.
8.7. Non-Discrimination
Slumberland does not discriminate against users who request to exercise their privacy rights. Unless an exception applies, this includes our promise not to:
• Deny you goods or services;
• Charge you different prices or rates for goods or services, including granting discounts or other benefits, or imposing penalties;
• Provide you a different level or quality of goods or services; or
• Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
While these rights are not globally applicable, users or Site visitors residing in certain states are afforded certain rights regarding their personal information. Except where an exception or exemption applies, these rights may include 1) The ability to request a copy of the information we have collected about you during the previous 12 months, as well as the right to review our data collection practices related to you (a “Personal Information Request”); 2) The ability to request deletion, correction, or limitation of your personal information; and 3) The right not to be discriminated against due to your exercise of any of the preceding rights. To protect your privacy and security, Slumberland may take reasonable steps to verify your identity before granting access to, correcting, or deleting data. We will generally respond to your request for information within 45 days, unless, for reasons beyond our control, a longer response time is necessary, in which case, you will be advised accordingly. Please note that we may retain certain information as required by law or as necessary for our legitimate business purposes.
